Welcome to TravelRooms.org

The service that introduces traveling guests to hosts all over the world. By using the TravelRooms.org website and indicating your acceptance of this agreement, you represent and warrant to TravelRooms.org, that you are at least 18 years old and that you are creating a legal document between you and TravelRooms.org. Please read the entire agreement prior to indicating that you accept the terms and conditions. TravelRooms.org reserves the right to change and alter the terms of this agreement without notice to you other than such notice as may be posted publicly for all others who have agreed to the provisions of this agreement. If you wish to become a Member and communicate with other Members and make use of the TravelRooms.org service, heretofore referred to as "our service", read these Terms and Conditions and indicate your acceptance of them by clicking on the appropriate box at the end of this document.

1. Membership.

   Only those 18 or older are authorized to register as a member of TravelRooms.org or use the Website. By using the Website, you represent that you have the right, authority, and capacity to enter into this Agreement and to abide by all of the terms and conditions of this Agreement whether you place a free listing or pay a fee for the service. TravelRooms.org does not promise or in any way guarantee that as a guest you will find a room with a host or as a host will secure a guest for a room in your home.

2. Term and Right to Terminate.

   This Agreement will remain in effect while you use TravelRooms.org or become a Member. You may terminate your membership at any time, for any reason by emailing or written notification to TravelRooms.org. TravelRooms.org may terminate your membership for any reason, including but not limited to violation of any terms of this agreement. Termination is effective upon sending notice to you at the email address you provide in your application for membership. If TravelRooms.org terminates your membership in the Service because you have breached the agreement, you will not be entitled to any refund of unused subscription fees.

3. Proprietary and Content Rights.

   You hereby give and grant to TravelRooms.org, its successors, assigns and licensees, all rights to use, copy, display, post, repost, distribute, make compilations, data bases, derivative and other versions of the Material including but not limited to incorporating the Material into other works, assigns and licensees both during the term of this agreement and after this agreement terminates for any reason and in perpetuity and may not be revoked by you for any reason. TravelRooms.org shall have the right to sell, assign and otherwise transfer any or all of its rights in this agreement to any other party.TravelRooms.org owns and retains all proprietary rights in the Website and the Service. The Website contains the copyrighted material, trademarks, and other proprietary information of TravelRooms.org, and its licensors. Except for that information which is in the public domain or for which you have been given written permission, you may not copy, modify, publish, transmit, distribute, perform, display, or sell any such proprietary information. TravelRooms.org reserves the right and by entering into this agreement you expressly consent to allow TravelRooms.org to access all Material and other information you post on Our Service as well as the right to monitor any and all activities on Our Service including the right to remove any Material that TravelRooms.org deems in violation of this agreement, but TravelRooms.org shall not have the obligation to do so and TravelRooms.org shall not, as a regular matter, review, edit, censor or otherwise maintain any supervisory role with regard to any such activities or such Material. You expressly consent to allow TravelRooms.org the right to store and make copies of all of your Material and other information you post. You expressly consent to allow TravelRooms.org to disclose to any other party all such Material and other information you post. TravelRooms.org is the proprietor of all of TravelRooms.org's copyrights, trademarks and other proprietary rights and you shall have no rights of any sort in and to nor shall you use any of TravelRooms.org's proprietary rights.

4. Website content.

   1. You understand and agree that TravelRooms.org may review and delete any content, messages, photos or profiles (collectively, "Content") that in the sole judgment of TravelRooms.org violate this Agreement or which might be offensive, illegal, or that might violate the rights, harm, or threaten the safety of Members.

   2. You shall be exclusively responsible for anything you post, publish or otherwise put up on Our Service or otherwise transmit to any other members of Our Service ("Material" in this agreement and the term "Material" shall include any information including any photographs, descriptions, e-mail information or the like you provide to TravelRooms.org) and everything and all Material that you post, publish or otherwise put up or transmit shall be subject to all of your representations, warranties, obligations and indemnities contained in this agreement.

   3. By posting Content to any public area of TravelRooms.org, you automatically grant, and you represent and warrant that you have the right to grant, to TravelRooms.org an irrevocable, perpetual, non- exclusive, fully paid, worldwide license to use, copy, perform, display, and distribute such information and content and to prepare derivative works of, or incorporate into other works, such information and content, and to grant and authorize sublicenses of the foregoing.

   4. The following is a partial list of the kind of Content that is illegal or prohibited on the Website. TravelRooms.org reserves the right to investigate and take appropriate legal action in its sole discretion against anyone who violates this provision, including without limitation, removing the offending communication from the Service and terminating the membership of such violators. It includes Content that:

      1. may violate the rights of any other party including but not limited to any rights of privacy, libel, slander, copyright, trademark or other rights nor any Material that is obscene, offensive, racist, sexually explicit, harassing or violates the laws of any state, country, province or any other governmental entity anywhere in the world;

      2. includes either your or any other party's telephone number, street address, last names, e-mail address, web site address, or any other contact information, anatomical or sexual references, or sexually suggestive language;

      3. includes any photographs, graphics or the like in any format containing nudity or personal information;

      4. includes any Material that is encrypted;

      5. includes any Material that is advertising or involves the commercial or other solicitation of any commercial nature, whether for you or any other party and whether or not considered to be "spam" or junk email and whether or not mailed individually or as part of a mass mailing; and

      6. includes any Material that may be deemed to be or is a chain letter or the like.

      7. is patently offensive to the online community, such as Content that promotes racism, bigotry, hatred or physical harm of any kind against any group or individual;

      8. promotes information that you know is false, misleading or promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libelous;

      9. promotes an illegal or unauthorized copy of another person's copyrighted work, such as providing pirated computer programs or links to them, providing information to circumvent manufacture-installed copy-protect devices, or providing pirated music or links to pirated music files;

      10. contains restricted or password only access pages, or hidden pages or images (those not linked to or from another accessible page);

5. Warranties/Guarantees.

   TravelRooms.org does not guarantee or warrant the information or material posted on our website. You are using our service at your own risk. TravelRooms.org shall not be responsible for, the correctness of any material posted on our service by any party and TravelRooms.org does not endorse or support any material posted by any party. TravelRooms.org shall not be liable for any acts or omissions by any party including but not limited to the acts or omissions of any other member of our service. TravelRooms.org does not warrant nor shall be responsible for the results of meetings between guests and hosts if any such meetings should occur. TravelRooms.org shall not be liable to you or any other party for any direct or indirect compensatory, special, incidental, or consequential damages or costs of any character including but not limited to damages or costs for personal injury of any sort, death, disease or illness of any sort, copyright infringement, trademark infringement, patent infringement, libel, slander, invasion of privacy, interference with the rights of publicity, loss of goodwill, loss of data, lost profits, work stoppage, computer failure or malfunction whether as a result of viruses or otherwise, nor for failure of TravelRooms.org's or any other web hosting or other server nor any failure of TravelRooms.org or any other party to provide internet access for any period of time nor for any cause outside of TravelRooms.org's control nor for any and all other damages or costs including punitive damages or losses. TravelRooms.org will not be liable for any damages or costs for the services rendered herein, even if TravelRooms.org shall have been informed of the possibility of such damages or costs, or for any claim by any other party. The within limitation of warranties may be limited by the laws of certain states or other jurisdictions and so some of the foregoing limitations may not apply to you and you may have other rights that may vary by state, province or country.

6. Copyright Policy.

   You may not post, distribute, or reproduce in any way any copyrighted material, trademarks, or other proprietary information without obtaining the prior written consent of the owner of such proprietary rights. Without limiting the foregoing, if you believe that your work has been copied and posted on the Service in a way that constitutes copyright infringement, please provide our Copyright Agent with the following information: an electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest; a description of the copyrighted work that you claim has been infringed; a description of where the material that you claim is infringing is located on the Website; your address, telephone number, and email address; a written statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; a statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

7. Privacy Policy.

   With the exception of any such Material that you have released for public posting, TravelRooms.org will never release your full name, mailing address, private e-mail address, telephone number, or any other personal information under any circumstances. You control the flow of information. Any credit card information that you may supply directly to TravelRooms.org for the purchase of services will not be stored after your purchase has been made. TravelRooms.org does not and will not share, rent, sell, or otherwise release your personal information or our mailing lists.

8. Indemnification.

   You agree to indemnify and hold TravelRooms.org, its subsidiaries, affiliates, officers, agents, and other partners and employees, harmless from any loss, liability, claim, or demand, including reasonable attorney's fees, made by any third party due to or arising out of your use of the Service in violation of this Agreement and/or arising from a breach of this Agreement and/or any breach of your representations and warranties set forth above. You shall defend and save and hold harmless TravelRooms.org, TravelRooms.org's affiliated and related corporations and other related business entities, their or TravelRooms.org' respective successors and assigns and their or TravelRooms.org's licensees, partners, employees, agents, attorneys, shareholders, officers, directors against any and all claims, demands, costs, awards, damages and the like, including attorneys fees, that may arise from a breach or claimed breach of any of your warranties, representations, promises or obligations under this agreement, whether or not a breach of those warranties, representations, promises or obligations is finally sustained and whether or not any litigation or claim is filed, or for any other cause of action or claims by any third parties including but not limited to any governmental body whether or not any litigation or claim is filed or sustained. These indemnities shall survive the termination of this agreement.

9. Acceptance.

   This Agreement, accepted upon use of the Website and further affirmed by becoming a Member of the Service, contains the entire agreement between you and TravelRooms.org regarding the use of the Website and/or the Service.
